24/7 Sobriety Program

The 24/7 sobriety program began as a pilot program in Yankton County in 2005 in cooperation with the South Dakota Attorney General's Office. The program is an alternative to jail and serves as an alternative sentencing option for the courts. The program is also used as a condition of bond and or sentence and can be used as part of probation or parole. The program is also utilized by the Department of Social Services for child custody issues.

Participants that are court ordered to participate in the program are generally ordered to do so with a Driving Under the Influence 2nd offense or higher. The length of time spent testing with the program is determined by the court on a case by case basis. In addition to twice a day breath testing for alcohol some persons can be ordered to submit to urinalysis testing for illegal drug use or ordered to wear a drug detection patch.

The courts can also order or allow the use of a SCRAM bracelet (secure continuous remote alcohol monitor) This is a device strapped to the subjects ankle and is worn 24 hours a day, 7 days a week.
In the event that a person were to test positive in the program or not show up for their required tests, they may be taken into custody and the court notified of their violation.

The 24/7 sobriety program is self funding through the requirement that the defendant pay costs of testing. The current fees for the program are:
  • Twice a day alcohol testing - $2.00 per day
  • Scram bracelet - $6.00 per day
  • Urinalysis Testing - $10.00 (plus $45.00) lab fee for positive test
  • Drug Patch - $50.00
  • State Fee - $30.00 - to PBT's. Testing fees are paid when tested. ($14)
  • Scram Activation - $40.00
  • Scram Deactivation - $40.00 - Testing fees for the week ($42) are paid in advance and due every Monday
The Yankton County Sheriff's Office averages 80 individuals monitored daily for their participation in the program.
